The Civil Guard of the Region of Murcia has arrested, on the road RM F-42 (El Algar-Atamaría), municipality of El Algar-Cartagena, the driver of the van that fled a breath test and drove for several kilometers with serious risk for the rest of users and two of the minor occupants.
The arrested person tested positive for the consumption of four narcotic substances and has his driving license withdrawn due to the loss of all the assigned points.
He is allegedly responsible for three crimes against road safety for driving recklessly, driving under the influence of drugs and doing so without driving license in force.
On the morning of Monday, February 12, members of the Cartagena Traffic Detachment established a blood alcohol and drug checkpoint on the RM F-42 highway (El Algar-Atamaría), at the height of El Algar, when they proceeded to give the police stop to a van.
His driver ignored the signals of the agents and started his escape by suddenly accelerating towards the population of El Algar, while driving in an anomalous way without respecting the speed stipulated for the layout of the road.
In addition, it advanced antireglatarily to other drivers and invaded the lane reserved for the opposite direction, forcing the vehicles that circulated correctly to make abrupt evasive maneuvers to avoid a collision.
Two minors were traveling in the vehicle
The excess speed maintained made the van to skid on its axis and be oriented in the opposite direction to the traffic where, despite trying to rejoin its lane, was intercepted by traffic agents before he could flee.
The agents found that, in addition to the driver, two underage passengers, family members of the detainee, were traveling in the van.
Positive in four narcotic substances
The driver, who was driving the van from the Llano del Beal-Cartagena to his home in Fuente Álamo, was subjected to the mandatory tests of alcohol and drugs, in which he tested positive for the consumption of four narcotic substances (cocaine, cannabis, amphetamines and methamphetamines).
Once verified his identity, the Civil Guard found that he lacked the driving license for loss of all the assigned points, since 2016.
As a result, three crimes against road safety were arrested as presumed perpetrators: driving in a reckless manner, driving under the influence of drugs and doing so without a driving license in force.
The Spanish arrested, of 23 years and neighbor of Fuente Álamo, along with the diligences instructed, has been put at the disposal of the Court of Instruction number 7 of Murcia.
The driving of a motor vehicle or moped with recklessness manifests putting in concrete danger the life or the integrity of the people is punished in the article 380 of the Penal Code with imprisonment of 6 months to 2 years and deprivation of the right to drive motor vehicles and mopeds for more than 1 and up to 6 years.
For its part, the crime of driving under the influence of toxic drugs, narcotics or psychotropic substances is found in article 379 of the Penal Code and can be punished alternatively with prison sentences of 3 to 6 months, fine of 6 to 12 months or works for the benefit of the community from 31 to 90 days and in any case with deprivation of the right to drive motor vehicles and mopeds for longer than 1 and up to 4 years.
Likewise, driving a motor vehicle or moped in case of loss of validity of the permit or license for total loss of the legally assigned points is sanctioned alternatively in article 384 of the Penal Code with imprisonment of 3 to 6 months, fine of 6 to 12 months or jobs for the benefit of the community from 31 to 90 days.
